General Terms & Conditions

One is obliged by law to inform the consumer, who enters into a legal transaction, about the following standing contract terms, if the transaction originated by Internet, E-Mail, Telephone, letter or by fax:

General:
Consumer in terms of these standard terms and conditions is any natural person who enters into a legal transaction (purchase contract) for a purpose, which cannot be attributed to his/her commercial or independent professional activities.

Merchant in terms of these standard terms and conditions is every natural person (or customer) who enters into a legal transaction for the purpose of commercial or independent professional activities.

Revocation and Obligation to return the Goods
In conformity with §§ 312b ff BGB every consumer has the right to return the goods within a period of 30 days (1 month) after delivery. The consumer is not required to give reasons for rescinding the contract.

Please inform us beforehand by E-Mail, telephone or fax, should you wish to return the goods.

The right of revocation excludes newspapers, magazines and illustrations (e.g. Adviser, Patterns) (§ 312d Abs.4 BGB).

In the event of effective revocation the consumer shall bear the costs of the return, if the delivered goods are as ordered and the value of the returned products does not exceed 40,00 Euro (§ 357 II BGB).

In case of a higher value we shall bear the costs for the return by post (insured mail only!). We shall reimburse your expenses against proof of postal charges (a copy of the postal-receipt will be sufficient). Post-free or C.O.D.-parcels will be refused! In the event of a parcel being returned, keep the postal receipt as a proof for the dispatch.

In the event of effective revocation, the services received by either party shall be returned and any benefits that may have been accrued shall be released. If the consumer is unable to return the received goods either in total or in part or only in deteriorated condition, the consumer shall indemnify us for the loss in value, if applicable. This shall not apply in the event that the deterioration of the surrendered goods is due to the inspection of the goods – as it would have been possible in a shop. The consumer may, moreover, avoid such liability of indemnification if he refrains from using the goods as if he owned them and further refrains from any action that would diminish the value of the goods.

The following goods are excluded from revocation/return:
Goods, which have been specially made or manufactured for you or were ordered just for you (see § 312d Abs.4, Satz 1 BGB), cuttings of fabric, special orders of articles which are not available from the usual assortment of the "Baerenbaude" stock as well as books, newspapers, magazines, illustrations, handicraft-sets, patterns and special-offer posts.

Warranty
The consumer is entitled to a two year warranty on new articles in the event of defect material.

If the delivered goods were a special second hand offer , the warranty shall be only one year, beginning at the time when the goods were delivered.

If the customer is a merchant, the warranty for claims in one year, even by the acquisition of new items (§ 479 BGB does not apply).

Personal Data Security
We store and use personalised data – including your postal address and e-mail address – for order handling and return delivery purposes only.

Your E-mail address will be used exclusively for status reports concerning your order and, if you haven't objected to it, for customer care information, as well as our own newsletters, if you've opted for the latter.

No disclosure of personalised data
We do not disclose your sensitive personal data including your postal address and your e-mail address to third parties. Excepted from this rule are our service partners who require a data transfer for the purpose of order handling. These partners include DHL (German Mail), HERMES Logistic and our bank (e.g. direct debiting). In these cases, the set of data transferred is reduced to the required minimum.

Information, correction, blocking and deletion of personalised data
You have a right of information about your data stored as well as a right of correcting, blocking or deleting it. In this case please send an e-mail to a.meier@baerenbaude.de .

Privacy acts
Personalised data is collected and stored in strict compliance with the statutory regulations of the Bundesdatenschutzgesetz (BDSG, Federal Data Protection Act) and Telemediengesetz (Telemedia Act).

Prices, Postage and Packaging
All prices include VAT. Prices do not include packaging/shipping-costs.
All parcels will be delivered by DHL (German Mail) or HERMES Logistic.

No additional charges will be raised if the consumer picks up the goods at Baerenbaude (after prior consultation by phone!).

Payment
Auctions & SHOP:
The consumer has the opportunity to make his payment "in advance". At the end of the auction the required payment-data shall be disposed. Payment "in advance" is also valid for purchases outside auctions, if not other payment option has been offered.

Manufacturing & Restoration:
For the designing of a special desired item, a separate sales contract shall be valid, which could repeal some of the rules committed in the existing sales contract. In this event all recission and revocations will be expressively revoked (§ 312d Abs.4, Satz 1 BGB).

In the event of placing an order respecting designing or restoration of a teddy bear, a partial payment of 20% from the actual price is payable within a period of 10 days (more information please see delivery period).

If items are collected at Baerenbaude, cash payment takes effect immediately.

Delivery can also be made by "cash on delivery" (C.O.D.). The fee has to be borne by the consumer.

Delivery period
Auctions & SHOP:
Unless otherwise agreed in textual form (e.g. by letter, E-Mail) the ordered goods shall be dispatched within 3 days after receipt of payment.

Manufacturing & Restoration:
Every teddy bear created by Baerenbaude is specially made in respond to individual demand by the consumer. Therefore we make it a principle not to begin with work until the agreed deposit has been paid. The date of delivery will be confirmed after receipt of payment.

Reservation of Title
All items (delivered by Baerenbaude) remain our property until the goods have been paid in full and all claims resulting from the sales contract have been met.

If the customer is a business or merchant, we reserve the right of ownership on our property until all claims which have arisen in connection with the sales contract, have been met (including all claims arisen through repeat orders).

If the customer is a merchant or does not reside within the European Union, our company seat shall be the exclusive venue for all legal disputes between the contract parties, including all lawsuits in connection with bills of exchange and cheques.

The laws of the Federal Republic of Germany shall exclusively apply. The provisions of the UN Convention on the International Sale of Goods shall not apply. Regarding commerce with end-consumers within the European Union, the relevant laws of that country may also be applicable, provided that it concerns obligatory consumer rights provisions.

In the event that one or several of the above provisions is or becomes invalid, the validity of the remaining provisions shall not be affected. The parties will try to replace invalid provisions by such provisions which are valid and come closest to the commercial purpose intended by the parties.
